VMC Membership Terms and Conditions
1. VUSH trading as VUSH PTY LTD (ABN 96635972593) (VUSH, we, us or our) operates the VMC platform, providing loyalty memberships to VUSH to which these terms and conditions apply.
2. You must be 18 years of age or over to sign up to an VMC membership.
3. Membership of VMC is subject to the terms and conditions that apply to the use of the VUSH/VMC website.
4. These terms and conditions are a binding agreement between us and each member of the VMC platform. By signing up to an VMC membership, you agree to these terms and conditions and our Privacy Policy. Please read these terms and conditions and Privacy Policy at joinvmc.com.au carefully before you purchase an VMC membership. For more information regarding our use of your personal information and opt-out procedures, refer to our Privacy Policy via the footer on joinvmc.com.au.
Entries into promotional draws
If you would like to receive access to VMC member only promotions, then you must hold a loyalty membership and be over the age of 18 years. Residents of ACT and Sth Australia are unable to enter.
11.Entries into promotional draws are otherwise subject to the terms and conditions associated with the relevant promotion, which should be read in conjunction with these membership terms and conditions noted here.
LOYALTY MEMBERSHIPS
12. Loyalty memberships to the VMC platform are ongoing subscriptions available on a monthly or yearly basis, depending on your selection. By enrolling as a loyalty member, you consent to automatic sign-up for direct debit, which ensures seamless payment processing. Your subscription will remain in effect until canceled by you or terminated by us in accordance with these terms and conditions. Please note that all subscriptions are set to auto-renew, automatically renewing on the specified monthly or yearly basis.
13. There are four types of loyalty memberships, as follows in AUD:

Entries into promotional draws
15. Loyalty members accumulate entries for each continuous month that they hold a membership. Entries are generated based on your current loyalty membership level. This means if you have held a loyalty membership for six months and have changed your membership status from one membership level to another during that time, the total number of entries you receive in a draw will be calculated in accordance with the membership level you hold at the time of the commencement of the promotional period, regardless of your previous membership status.
Example: If you hold a VIBER membership for four months you will receive 25 entries per month into a promotional draw, meaning 100 total accrued during month 4. However, if you then decide to downgrade your membership to the rookie membership for your fifth month and we generate entries for a promotion while you’re on the rookie tier, you’ll only receive 10 entries for that month (added to your previously held 100), which would leave you with 110 entries. If you then upgrade back to the viber membership for your sixth month, and we generate entries for a promotion you will receive 25 entries for that promotion (135 total). All entries in this example will still add to your accumulated entries.
Note: For customers with an annual membership, their entries will remain consistent throughout the entire year until they opt for renewal. In instances where a customer transitions from a monthly membership to an annual membership, their existing entries will be retained, and the new annual membership entries will be added on top of the previous ones for that year.
16. Loyalty membership entries into promotional draws are generated before the relevant promotion period commences. Please check the VMC member portal via www.joinvmc.com.au to view your entries. If your entries are not showing inside your portal, please contact us at info@joinvmc.com.au with your full contact details as recorded in the VMC Members Portal.
17. Entries into promotional draws are otherwise subject to the terms and conditions associated with the relevant promotion, which should be read in conjunction with these membership terms and conditions.
Upgrade or downgrade of Loyalty Membership
19. You can request to upgrade or downgrade your loyalty membership at any time through your portal, however it will come into effect on your next billing cycle. No refund will be offered if you opt to downgrade your membership mid-billing cycle.
TERMINATION OF MEMBERSHIP
20. You may cancel your membership at any time by logging into your VMC portal and going to Membership.
21. Once the cancellation process is complete, your membership will be canceled instantly and you will be sent a confirmation email. No refund will be offered if you cancel your membership mid-billing cycle.
22. Cancellation of your membership will not remove you from our marketing database. To remove yourself from our marketing database you must click the unsubscribe link in the promotional email or SMS message (as relevant) and follow the prompts. You can email us at info@joinvmc.com.au to remove your email from our marketing database for VMC and VUSH.
23. If you hold a loyalty membership and, for any reason, a direct debit for payment of your loyalty membership fails, we will attempt to debit you payment on four further occasions every five days over a 15 day period after the initial payment failure. If, after five attempts, we are unable to debit your loyalty membership payment, your loyalty membership and all membership benefits will be terminated.
24. You may re-subscribe to a loyalty membership at any time. If you re-subscribe within 30 days of cancelling your loyalty membership or your loyalty membership being cancelled by us, you will retain all previous benefits you held under your last loyalty membership. However if you do not re-subscribe to a loyalty membership within 30 days of cancellation or termination, any previous benefits you had as a loyalty member will not carry over.
MEMBERSHIP SIGN-UP BONUSES
25. From time to time we may offer sign-up bonuses, special offers or free trial periods. These bonuses, special offers and free trial periods are only valid in accordance with the terms and conditions which apply to that bonus, special offer of free trial period.
26. If you sign up to a free trial period and do not cancel before the end of the free trial period, your nominated payment method will be automatically deducted in accordance with the loyalty membership terms set out above until you cancel your membership in accordance with these terms and conditions.
CHANGE OF DETAILS
27. You should notify us of any change of name, address, contact number, email address or billing information by updating your details online at joinvmc.com.au
28. We will not be responsible for any failure by you to notify us of your change of details, which may result in you not obtaining the full benefit of your VMC membership.
LIABILITY
29. We do not exclude any rights and remedies in respect of goods or services under the Competition and Consumer Act (2010) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and we and our partners are not be liable (including in negligence) for any loss (including but not limited to indirect, special or consequential loss or loss of profits), expense, damage whatsoever which is suffered or for any personal injury, illness or death suffered or sustained in connection with VMC membership, except for any liability which cannot be excluded by law.
GENERAL TERMS AND CONDITIONS
31. We are not responsible for any tax implications arising from you using the VMC platform or receiving any benefit from it.
32. We may exclude or suspend you from the VMC platform or from receiving benefits from the VMC platform if you:
a. engage in conduct that may jeopardise the proper conduct of the VMC platform;
b. act in a disruptive, annoying, threatening, abusive or harassing manner;
c. do anything that may diminish the good name or reputation
d. breach any law in connection with the VMC platform or your participation in our promotions; or
e. behave in a way that we reasonably believe is otherwise inappropriate.
33. You must not assign or attempt to assign any right or liability under these terms and conditions without our prior written consent.
34. Any term of these terms and conditions that is expressed to survive, or by its nature survives, the termination or expiry of these terms and conditions will survive and continue in effect following such termination or expiry.
35. All references to $ in these terms and conditions are in Australian dollars.
36. We may, from time to time, amend these terms and conditions. The amended terms and conditions will apply from the time they are posted on the VMC website or are otherwise notified to members. If you do not wish to accept any amendments to these terms and conditions, you may cancel your VMC membership.
37. We may cease offering memberships by notifying members on the VMC website or otherwise, provided that we provide sufficient notice so that the termination does not cause unreasonable financial or other detriment to members.
38. These terms and conditions are governed by the laws of Victoria, Australia.
Member Perks
As part of your membership with the VUSH Members Club (VMC), you are entitled to a range of exclusive perks based on your chosen membership tier. These perks are outlined below and are subject to the following terms and conditions:
1. Free Shipping

- Members are entitled to free shipping on all VUSH orders with a minimum spend $20 AUD after discounts applied

- Free shipping applies only to standard delivery and excludes express or premium delivery options, unless otherwise stated in your membership tier.

- Orders must meet the minimum order value of $20 AUD after discounts or gift card usage to qualify.

- VUSH reserves the right to amend or suspend free shipping benefits at any time, with notice provided to members via an update of the offer in the Members portal.
2. Exclusive Member Discounts

- Members gain access to discounts of up to 75% off selected VUSH products through the VMC membership portal, discounts are subject to change and/or alteration.

- Discounts are only available via the portal and cannot be applied to purchases made outside the VMC portal.

- Discounted prices are subject to availability and may change without prior notice. Ensure you view the latest offer in the portal before making a purchase.

- Certain products or categories may be excluded from discount eligibility at VUSH’s discretion.
3. Routine Gift Boxes

- Gift boxes are curated and delivered to members based on their membership tier at the following intervals:
Monthly members:

- Explorer: No Gift box
-
- Rookie: One annual gift box. Sent at the 12 month mark of consistent membership.

- Viber: Bi-annual gift boxes (two per year). Sent at each 6 month mark of consistent membership.
-
- Insider: Bi-annual gift boxes (three per year). Sent every 4 months of consistent membership.
-
- Clubber: Tri-annual gift boxes (three per year). Sent every 4 months of consistent membership.
Annual members receive their BONUS WELCOME gift box immediately, dispatched within 2-4 Weeks of sign up.

- Gift boxes are dispatched to the shipping address provided in your membership account. Members are responsible for ensuring their shipping details are accurate and up to date.

- A member will be sent a gift box of whatever membership type they hold at the time of dispatch. Upon downgrading, the member’s gift box cycle is reset to align with the new tier’s schedule. For example: If a “Clubber” member (who receives quarterly boxes) downgrades to “Viber” (bi-annual boxes) midway through the year, the next gift box will be sent six months from the date of the downgrade.

- If an upgrade back to previous tier occurs within 30 days of downgrade, then the member will retain previous timeline of membership and gift box.

- In the event that a member upgrades mid-giftbox-cycle to a higher tier, and therefore different gift box timeline, VMC will dispatch a giftbox at whatever timeline is shorter between the previous duration of gift box dispatch, and the revised.

- Gift box contents are curated at VMC’s discretion and may vary between shipments. Gift box values are approximate and cannot be exchanged, refunded, or substituted.

- Shipping delays may occur due to external factors; VMC is not liable for delays outside of its control.
-
- If a member cancels their membership before the next scheduled gift box shipment, they will not receive the remaining boxes for that membership cycle.
4. General Conditions for Perks

- Perks are non-transferable and are only available to the named member on the account.

- Perks may not be redeemed for cash or any other monetary equivalent unless explicitly stated.
-
- VMC reserves the right to modify or discontinue any perk at its sole discretion. Members will be notified of any changes via email or the member portal.
-
- Misuse of membership perks, including but not limited to sharing of exclusive codes and offers, reselling discounted products or attempting to redeem multiple gift boxes, may result in the cancellation of membership and forfeiture of all benefits without a refund.
Partner Brand Specific Terms and Conditions
Some of the partner brands will have their own terms and conditions, please ensure you are familar with these prior to purchasing a membership. No refunds will be provided to VMC based on changes to the brand partner offers or discounts.
Naked Wines
The boring bits: To use this voucher you must be 18 years or older. Delivery not included. This voucher entitles first time Naked Wines customers to $100 off their first order of 12 bottles. All orders are a minimum of 12 bottles, and a minimum spend of $155.88. GENERAL TERMS
If you win a prize, you must take part in all publicity, photography and other promotional activity we reasonably require in connection with the promotion and prize, without any compensation. By participating in the promotion and accepting any prize, you consent to us using your name and/or image in any promotional or advertising activity in connection with the promotion and prize. However, we will never publish your full address.
We may require you to sign disclaimer and release forms in favour of VMC and/or our prize suppliers, which we will provide before taking a prize. If you do not sign, your entry will be deemed invalid and you will lose any right to a prize.
We reserve the right to disqualify any Eligible Entrant in the promotion who:

- is found to be tampering with or otherwise abusing any aspect of the promotion; we have reason to believe has breached any of these terms and conditions; behaves in a disruptive, abusive or threatening manner;

- does anything that may diminish the good name and reputation of us or any of our related entities or the companies or agencies associated with the promotion; or engages in any other unlawful or inappropriate conduct that may jeopardise the fair and proper conduct of the promotion.

- In the event that the promotion is compromised by non-authorised human intervention, tampering or other causes beyond our reasonable control that corrupt or impair the administration, security, fairness or proper operation of the promotion, we reserve the right to suspend, modify or terminate the promotion, subject to any necessary approval by the relevant gaming authorities.

- We are not responsible for any problems or technical malfunction of computer systems, servers, software, internet service provider, or e-mail systems, failure of any entry to be received on account of technical problems or incomplete, late, lost, damaged, illegible or misdirected electronic communications, or any combination thereof.

Promotion Period
The promotion commences at 19:00 AEDT on 2nd May AEDT and concludes on Friday 23rd May 2025 at 17:00 AEDT (Promotion Period).
Eligibility
- Entry is open to residents of NSW, VIC, NT, TAS, QLD and WA who are aged 18 years or over.
- SA and ACT, Torres Strait or Pacific Island residents are not eligible to participate in giveaways.
- Employees, directors, management, officers, and immediate family members of the Promoter or its associated agencies are not eligible to enter. Immediate family includes spouses, de facto partners, parents, children, siblings, and step-relations.
- Entry is void where prohibited by law.
How to Enter
To enter, participants must:
- Hold a valid VMC membership
- Aged 18+ years of age at the time of entry
- Eligible entrants will receive automatic entries based on membership tier per members total entries as calculated at time of draw.
Prize Pool
- The total prize pool is valued at $7,500 travel package, including applicable taxes or $5,000 Cash value- winner can select their prize.
Prizes
- The prize(s) available are as follows all values are in AUD.
- A travel voucher valued at up to $7,500, which can be used towards flights and accommodation for two people. The package allows the winner to select their preferred flights and accommodation within the allocated budget.
- Or $5,000 aud cash.
- Prizes do not include transfers, travel insurance or other arrangements/activities and travel needs that sit outside of the package prize offer.
- Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash unless specified.

Equal Chance
- All valid entries have an equal chance of winning. Winners are selected by random draw.
Drawing of Prizes
The prize(s) will be drawn at 18:00 ADST, Live on Instagram Friday 23rd May 2025
The draw will be conducted via computer-generated random draw with the winner announced as the time specified
Winners do not need to attend the draw to claim their prize.
Notification of Winners-Winners will be notified within 24 hours of the draw via phone call, and if applicable, a follow up email and text message.
The names of winners will be published on the VMC membership portal page (www.joinvmc.com.au) as well as on primary site within Membership section for a minimum period of 28 days. By entering the giveaway, you agree to this promotion.
Claiming Prizes
Winners must claim their prize within 30 days of being notified.
If a winner fails to claim their prize within the stipulated period, the prize will be forfeited, and a redraw will occur.
Unclaimed Prizes
Unclaimed prizes will be redrawn on on day 31 after the original draw date on Instrgram Live, and the new winner(s) will be notified as per the process outlined above.

6. Winner’s Social Proof Requirement: Winners must take a photo with the big cheque provided which will be shared on VMC’s social media channels. This photo will be used for social proof and brand trust purposes. Failure to comply may result in forfeiting the prize.
7. Notification of Winner: The winner will be notified by direct message on Instagram, and must respond within 48 hours to claim the prize. If no response is received within the specified timeframe, a new winner will be chosen.
